Asbestos in Flanders: certificates and renovation

In Flanders, distinguish the building’s asbestos certificate from investigation of the actual work area and preparation of removal. For a jointly owned building built before 2001, also check the common-parts file with the building manager.

Is an asbestos certificate enough before renovation?

An asbestattest describes asbestos identified through a mainly non-destructive survey. It informs prospective buyers, among others. It does not establish that every hidden layer behind ceilings, under floors or within a roof has been examined.

Give the surveyor the existing certificate and a precise description of your work. Areas that will be opened may need further investigation, including a destructive survey where necessary. Establish that scope before commissioning the affected demolition or renovation.

A certificate is required for certain transfers to a new owner of accessible structures built before 2001. Exceptions and aggregation rules apply, including for structures smaller than 20 m². The notary confirms the scope and required timing. Renting alone does not currently trigger a new certificate, but a copy must be given to tenants if one exists. From 2032, owners of the relevant structures will also need a certificate without a transfer. That deadline concerns the document, not a general requirement to remove all asbestos.

OVAM also announces a 2030 certificate requirement for new leases and certain workplaces in buildings predating 2001. As of 4 October 2026, its FAQ still describes these measures as an ongoing decree amendment. Check the adopted text before treating that deadline as applicable to your building.

For buildings, a demolition follow-up plan (sloopopvolgingsplan) is also mandatory for demolition, renovation or dismantling requiring a permit when the total building volume exceeds 1,000 m³ for non-residential buildings, or 5,000 m³ for mainly residential buildings, excluding single-family houses. This means the volume of the buildings covered by the same permit, not the rubble volume. That exception does not remove asbestos duties.

The plan also records other waste, estimated quantities and locations. It forms part of the permit application; the version declared compliant accompanies quote requests and contracts. The traceability system is mandatory for these projects. The sloopattest supplied before handover confirms waste tracking and serves a different purpose from the building’s asbestos certificate.

Common parts: the 31 December 2026 deadline

OVAM states that the relevant associations of co-owners must hold an asbestos certificate for the common parts of buildings built before 2001 by 31 December 2026. From 1 January 2027, transfer of a private unit must also include the common-parts certificate. If that certificate already exists before this date, it must already be disclosed to the prospective buyer when the unit is transferred.

An apartment’s certificate does not automatically cover the shared roof, facades, staircase or boiler room. Check the boundaries against the building’s founding deed with the manager. For proposed work, collect reports for the affected common and private areas and identify any missing investigation.

Roofs, facades and solar panels: what comes first?

OVAM prohibits installing solar panels or an overlay roof on asbestos-containing external roof coverings. Covering an asbestos facade is also prohibited. A different fixing method does not remove these restrictions.

If asbestos is present only in the roof underlay, the installation restriction applies where the work could damage it. Establish which layer is affected before approving the solution. Schedule any necessary removal before the roofer, facade contractor or solar installer works on that area.

Property managers and tenants: planning access to common parts

If an asbestos certificate exists for a rented home, the landlord must give the tenant a copy. For work in common parts, also obtain the co-ownership’s file: a report for one flat does not automatically describe shared ducts, the roof or the boiler room.

Before proposing dates, ask the manager to identify occupied rooms, affected shared services and who needs to be informed. Have access restrictions and continued occupancy assessed. The ‘asbestveilig’ conclusion concerns normal use and does not, by itself, approve occupancy during work.

Who removes the waste and what evidence should you keep?

OVAM states that a contractor hired to remove asbestos is also responsible for taking away the waste. Include this in the quote. Request a copy of the signed waste identification form, or an equivalent receipt showing where the waste came from and where it was delivered.

Recycling-park and local collection conditions vary. Non-bonded asbestos waste cannot go to a recycling park. A household collection scheme does not, on its own, establish a suitable waste route for a professional worksite.

Does ‘asbestveilig’ mean asbestos-free?

No. A building can be classed as ‘asbestveilig’ while still containing low-risk asbestos materials. Hidden asbestos is not ruled out either. Read the material records again before defining the work.

Flanders’ 2034 and 2040 targets are not blanket removal deadlines for every private owner. Duties already apply in dangerous situations and during renovation: asbestos that becomes easily accessible during the work must be removed. The statutory removal deadlines for public buildings are mandatory.

Unexpected discovery or contamination: who should you contact in Flanders?

If work reveals asbestos missing from the inventory, the contractor must apply federal measures before resuming. Notify the site manager and provide the existing report; do not open the area further to complete the file.

For an environmental incident, OVAM directs people first to the municipality’s environmental supervisor. The labour inspectorate is also responsible where workers handle asbestos carelessly. Questions about a certificate’s contents should go to the expert who issued it.

Does the certificate need renewing after removal?

A new certificate is required within a year if previously unlisted asbestos is found, an incident damages asbestos, or work changes the conclusion from ‘niet-asbestveilig’ to ‘asbestveilig’. Partial removal without a changed conclusion does not, by itself, trigger renewal.

Have a certified expert assess the updated file. The renewal period does not allow an invalidated certificate to be used for a sale.

Roofs, solar panels and sector support: what should you check?

The roof asbestos bonus under Mijn VerbouwPremie can amount to €8/m² when combined with new insulation rated at least Rd 4.5 m²K/W. Caps and building conditions apply. Since 1 March 2026, owner-occupiers in categories 1 and 2 cannot claim the roof grant. Categories 3 and 4 and letting to a housing company have their own conditions. Common parts have a separate scheme.

Prepare invoices, the insulation certificate and the contractor’s signed asbestos removal certificate. The asbestos form requires the 30bis works declaration number. The FPS Employment notification date is an alternative only when the works are exempt from 30bis. Check before work starts: missing or late information can jeopardise the bonus.

Request separate costs for removal, insulation and roof covering. Your Energiehuis or municipal housing desk can check the file. Compare full totals before deducting unapproved support; grant paperwork does not replace statutory worksite notifications and deadlines.

As of 4 October 2026, OVAM no longer accepts new registrations for farm and horticultural asbestos collection. This service covers collection and treatment, not roof dismantling. Do not deduct its cost from the quote without admission to the scheme.

The school removal call closed on 30 September 2026. No removal call for care facilities is open on 4 October. Expert support may remain available under OVAM’s eligibility conditions.
